A prenuptial agreement is a contract entered into by the parties prior to the marriage. The agreement may be used to protect property or businesses acquired before marriage, to protect inheritances or gifts from others, to protect against accruing a marital interest in what would otherwise be considered separate property, and to limit or eliminate alimony. Prenuptial agreements are generally enforced in Georgia, as long as they are properly drafted and executed.
